Your use of this Web Site is expressly conditioned on your acceptance without modification of the following terms and conditions (the "Terms and Conditions") and constitutes a contract between you and Dep.ca. Dep.ca reserves the right to modify these Terms and Conditions at any time.
1. TERMS OF USAGE
A. Territory of Operations
Dep.ca is controlled by DEP Distribution Exclusive Ltée from its offices in Montreal ( Quebec , Canada ). Although the Web Site is accessible to all provinces of Canada , Dep.ca shall not be held responsible should this Web Site be accessed by users outside of Canada . Moreover, Dep.ca shall not be held responsible if this Web Site is accessed by users in a territory where jurisdictions and laws prohibit doing so. Users who access this Web Site do so at their own initiative and therefore agree and acknowledge to be governed by any and all applicable jurisdiction laws. All disputes arising out of or relating to the use of Dep.ca and these Terms and Conditions shall be governed by the laws in the Province of Quebec .
B. Restrictions on Use
Unless otherwise confirmed on the Web Site, it is strictly prohibited to copy, reproduce, distribute, publish, translate, download, post or transmit any information from this Web Site, be it in whole or in part, without written consent from Dep.ca or its copyright holders. In instances where you are permitted to post or to download certain materials from the Web Site, it must be solely for a non-commercial use and said materials may not be modified by any means. You must retain all copyright and trademark notices, including any other proprietary notices, contained in the materials.
The trademarks and logos used or displayed on the Web Site are trademarks, registered or not registered, of DEP.ca and/or its affiliates. All trademarks owned by Dep.ca or its affiliates that appear on the Dep.ca Web Site are the property of their respective owners. The use of any trademarks or logos is strictly prohibited unless you obtain a written consent from the respective owners.
D. Limitation of Liability
Dep.ca makes no representations or warranties of any kind, express or implied, as to the operation of this Web Site or as to the content, materials or products included on the Web Site. Dep.ca will not be liable for any damages of any kind arising from the use of the Dep.ca Web Site, including, but not limited to, direct, indirect, incidental, punitive and consequential damages. Although Dep.ca strives to produce an error free environment, Dep.ca declines any responsibility for any direct, indirect, incidental, punitive and consequential damages allegedly sustained by you or any third parties from your use of our services and/or content of the Web Site or your inability to access or use the Web Site.
2. GENERAL TERMS AND CONDITIONS OF SALE
Receipt of an email confirming your purchase does not necessarily signify that Dep.ca has accepted the order and does not confirm that Dep.ca has agreed to sell you the item(s) of said order. Dep.ca reserves the right, without any prior notice, to refuse a client's order and/or to limit the quantities of an order. It is necessary for Dep.ca to verify all personal credit card information before accepting any and all orders.
A . Price
A.1. The price of each item that you order is the price that is posted on the Web Site.
A.2. Shipping and handling charges as well as all applicable sales taxes are extra.
A.3. Prices are subject to change. Dep.ca reserves the right to correct, at any time, any pricing errors.
A.4. All prices are quoted and payable in Canadian dollars.
B. Returns Policy
B.1. You may, by all means, return items purchased at Dep.ca, within 30 days of delivery of your shipment, by contacting us, via email, at ( firstname.lastname@example.org ). Upon receipt of a return authorization number, the item(s) must be returned to the following address: Returns Dep.ca, 6255, Hutchison, Suite 103 , Montreal , Quebec , H2V 4C7 . The invoice and order number must accompany the returned items.
B.2. All return shipping costs are the responsibility of the customer and Dep.ca will not refund return shipping costs. Dep.ca is not responsible for any returned shipments that may be lost through the postal system. However, should the return result from an error made by Dep.ca or if you were sent defective or damaged products, Dep.ca will assume all shipping costs and responsibilities associated to return the product(s) in question to our offices. The transport company chosen by Dep.ca shall offer a guarantee against loss and damages.
B.3. In respect to articles 2.2.1 and 2.2.2, you cannot return an item that has been removed from its original packaging unless the item is defective or damaged. Dep.ca can replace the item only after the original item is returned.
B.4. Upon receipt of returned items, a refund, excluding shipping and transportation charges, will be debited, as soon as possible, to your credit card, on the condition that said return was sent by you to Dep.ca in the original condition and packaging in which it was received by the purchaser.
C. Product Availability
C.1. This Web Site posts products available through our suppliers. Please note that the latter does not necessarily represent the inventory of the Web Site. In the event where Dep.ca must wait for an item on back order to become available, it is possible that your order be held in our warehouse until such item is available. Should you require an item or items from your order immediately, we recommend that you submit a separate order for the former.
C.2. Dep.ca does not guarantee, in any way, the availability of the products posted on our Web Site. Should Dep.ca be unable to ship you one or more of the items ordered because said items are back ordered, we will advise you by email and you will have the following options:
C.3. You may keep your order active and authorize the Web Site to ship you the back ordered items, without notice, once they are received from our suppliers. A payment will automatically be withdrawn from your credit card before the items are shipped by a preferred transport company. You may, before the Web Site receives the back ordered items, cancel your order by communicating with the Web Site's Customer Service department. Please note that the back ordered items will only be ordered from our suppliers if you choose to keep your order active on the Web Site.
C.4. If you choose to cancel your order on the Web Site, no payment(s) will be withdrawn from your credit card for the back ordered items.
C.5. Please note that orders containing back ordered items will automatically be cancelled after 90 days without any prior notice.
C.6 Dep.ca is not in anyway liable or responsible for any damages that you may have endured due to an item being of back order status.
D.1. Dep.ca will not ship any products outside of Canada.
D.2. Dep.ca will ship your order to the address transmitted to us via your order.
D.3. Shipping and transportation costs are relevant to the number of items ordered.
D.4. Your order will be shipped by Dep.ca as quickly as possible, upon acceptation of your order and according to the method of shipment chosen on the Web Site. The shipping costs and delays may vary according to the destination of the shipment, the method of transportation chosen, and the availability of the item(s). The shipping delays begin once the order has left the premises of Dep.ca.
D.5. The delivery of products is subject to the rules and regulations of the shipping companies from which Dep.ca chooses to do business with, in this case Canada Post, as well as any other company that Dep.ca may choose, from time to time, to do business with. If the case arises, you are hereby subject to the rules and regulations regarding the signature of an acknowledgement of receipt for the products ordered. If you are absent from the delivery address confirmed to us on your order, you will hence become responsible to follow the rules and regulations of the shipping company you had chosen while placing your order on our Web Site.
D.6. No shipments will be made to any Postal Boxes.
D.7. Dep.ca must receive the entire payment for the items ordered before said items are released for shipment.
E.1. Dep.ca's total liability for any claims, whether in contract, warranty or otherwise shall be limited to the price of the items returned.
E.2. Notwithstanding the preceding, nothing in the current section can limit your rights as a consumer in virtue of the public order laws that may be applicable in your set of circumstances.
F. Acts of God
Dep.ca shall be exempt from all liability, damages and losses, be it in whole or in part, if some unforeseen events (Acts of God) prevent us from being able to perform our obligations under the contract.
Your use of the Dep.ca site is clearly conditioned on your acceptance without modification of the preceding Terms and Conditions. By using Dep.ca, you confirm your acceptance of these Terms and Conditions.
